DIFFERENCE
OF RAPE IN Cr.PC
a)
“Bailable offence” means an offence
which is shown bailable in first schedule, or which is made bailable by any
other Law for time being and force; and non-bailable means any other offence;
b)
“Charge” includes any head of charge
when the charge contains more head than one;
c)
“Cognizable Offence” means an offence
for which and “cognizable Case” means a case in which, a police officer may, in
accordance with the first schedule or under any other law for the time being in
force, arrest without warrant.
d)
“Complaint” means any allegation made
orally or in writing to magistrate
Cognizable offence is offence in which police
officer may arrest an accused without warrant.
Non- Cognizable is one in which police officer
shall not arrest an accused without warrant.
PUNISHMENT FOR THE OFFENCE OF RAPE IN
CR.P.C.
U/s. 376 which is the offence of RAPE” for which
there is punishment of imprisonment of life or imprisonment for 10 years and fine
and the offence is Non-Bailable but if the same crime is committed by the
public Servants then u/s 376-B offence is Bailable and 5 years imprisonment.
IS THIS LAWFUL??
Is this Lawful? Is this the justice?? I feel Rape
is a severe offence which not only attacks physical harm of the victim but also
ruin the mental ability of such victim. It is a trauma which remains same no
matter how long years passed after such trauma. Why this difference has been
made in Cr.P.C?? Instead of such difference
there should be more severe punishment for such an offence. We should not forgive
god also, or not if it is committed by any religious priest or sadhu.
